This topic seems to crop up from time to time and the main reason appears to be the lack of consistency in the application of the law by the various authorities. The legal position is quite clear, anyone in possession of an EU license is entitled to use that license freely throughout the EU. This means that it is not necessary to change your UK license for a Spanish one, although there are some important considerations to bear in mind:
Insurance – I have been assured on many occasions that the mere possession of a Spanish license will result in a cheaper premium being payable for the same level of cover as would be offered to the holder of a driving license issued outside of Spain. I cannot vouch for this although it is certainly worthwhile checking with your broker or agent whether this applies to you.
Dealing with the Guardia - The important point to remember at all
times is that the friendly chap from the guardia may not be fully
familiar with the law and will possibly try to issue you (as the
driver) with a fine for not being in possession of a Spanish license.
Rather than shouting loudly in English it will always be in your
interests to cooperate and explain as politely as possible that the
law permits you to drive in Spain with your UK license.
Revalidation of your License – A foreign national is obliged
(not unreasonably) to follow the same rules as a Spanish person.
This means that you need to revalidate your UK license every ten
years up until you reach 45, thereafter every 5 years up to the age
of 60 and every two years after that.
Documents to keep in your car whilst driving – You are obliged
to carry your driving license as well as the car’s registration
and insurance documents at all times. In addition, you need to carry
two red warning triangles as well as a reflective vest. Personally
I feel that one of the most useful items to keep in your glove compartment
is a disposable camera so that you can take photos after an accident
if necessary (ie so as to identify the other car as well as its driver,
the location of the accident and any other important evidence such
as the amount of daylight and any skid marks). In that way you
can hand the ambulance-chasing lawyers all the evidence they will need.
